Terms of Service

1. Acceptance of terms

By accessing or using OpenBot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms govern OpenBot managed services — the developer platform at platform.openbot.ai and the API at api.openbot.ai. A verified Google or GitHub account may create a self-serve account while registration is open. We may refuse, suspend, or close accounts that violate these Terms or create security, legal, or abuse risk. Public OpenBot repositories are governed separately by their repository licenses.

2. Service description

The public and managed OpenBot surfaces currently include:

  • Catalog · Live: Source-backed dataset and model records for browsing and research.
  • openbot-data: An open-source local toolkit governed by its repository license, not this managed-service agreement.
  • Platform API: API-key, access-control, usage, and billing infrastructure. Only operations present in the deployed OpenAPI contract are available.
  • API and console: An API-first platform framework with organization keys and only the capabilities explicitly present in the deployed contract.

3. Account responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of unauthorized access.
  • Ensuring your use complies with these Terms.

You must be at least 16 years old to use the Service. You must provide accurate and complete information when creating your account.

4. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any law.
  • Reverse engineer protected parts of the managed Service except where applicable law or an open-source license permits it.
  • Access unpublished, disabled, or internal operations through automated means.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Use the Service to transmit malware, viruses, or harmful code.
  • Attempt to gain unauthorized access to any part of the Service.

Automated use of endpoints published in the deployed OpenAPI contract is permitted with a valid API key, subject to its explicit scopes, rate limits, availability gates, and these Terms.

5. Payment and billing

OpenBot 0.1.0 is offered as a Free Beta for validation. Production purchases and live checkout are disabled, and use of beta credits does not create a payment obligation.

We may introduce paid services in a future release. Before any paid terms take effect, we will present the applicable pricing, payment, cancellation, and refund terms and obtain any consent required by law. These Terms do not make a current paid-service or non-refundable-fee commitment.

6. Data and content

You retain ownership of data you explicitly submit through an available platform API or support channel. By submitting it, you grant us the limited right to store and process it solely to provide the requested service. The local openbot-data toolkit does not upload your dataset to OpenBot. We do not claim ownership of your results or outputs.

You represent that you have all necessary rights to upload any data and that doing so does not violate any law or third-party rights.

7. Service availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control. We are not liable for any downtime.

8. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms.
  • Failure to pay amounts validly incurred under separately accepted future paid terms, if applicable.
  • Suspicious or fraudulent activity.
  • Discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable period unless legal requirements prevent it.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  • NON-INFRINGEMENT.
  • ACCURACY OR RELIABILITY OF RESULTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless OpenBot from any claims arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which OpenBot is established. Any disputes shall be resolved in the courts of that jurisdiction.

13. Changes to these terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice. Continued use after changes constitutes acceptance.

14. General provisions

These Terms constitute the entire agreement between you and OpenBot. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
